Introduction to the Usage Agreement
Welcome to our online store. Below you will find the terms and conditions governing your use of this store and the legal consequences arising from your use of its services through this electronic platform.
By using the store, whether as a customer purchasing a product or service or otherwise, you acknowledge that you have the full legal capacity required under applicable laws and agree to be bound by all provisions of this Agreement. This Agreement applies to all transactions between the customer and the store and becomes effective once you accept it and begin registering with the store, in accordance with Article 10 of the Saudi Electronic Transactions Law.
Article 1 – Introduction and Definitions
The introduction above forms an integral part of this Agreement. The following terms shall have the meanings stated below:
- Store: Includes all forms of the store, whether an electronic application, website, or physical retail store.
- Customer: Any person who engages in e-commerce for the purpose of obtaining products or services offered by the store through its electronic platform.
- Agreement: These Terms and Conditions governing and regulating the relationship between the parties to this Agreement.
Article 2 – Customer Legal Eligibility
- The customer confirms that they have the legal capacity required under applicable laws to deal with the store, or that they are at least 18 years old.
- If the customer violates this provision, they shall bear responsibility for any consequences arising from such violation toward third parties.
Article 3 – Nature of the Store’s Obligations
- The store’s primary obligation toward customers is to provide the requested products or services.
- The store may also provide additional services, such as after-sales services or other related services, depending on the nature and type of the product or service requested.
Article 4 – Rules of Use
- The customer agrees to use the store’s electronic platform in accordance with public morals and the laws and regulations applicable in the Kingdom of Saudi Arabia.
- When purchasing any product or service from the store, the customer agrees not to use it in any manner that violates public morals or the laws and regulations of the Kingdom of Saudi Arabia.
Article 5 – Accounts and Registration Obligations
When applying for membership or creating an account with the store, you may be required to provide certain information and select login credentials to access the store’s services. By doing so, you agree to the following:
- You are responsible for maintaining the confidentiality of your account information and password and must immediately notify the store of any unauthorized use of your account or any other security breach.
- The store shall not be responsible for any direct or indirect, material or non-material loss resulting from the disclosure of your username, account information, or password.
- You are responsible for the use of your account or membership. If another person uses your account, this may be considered authorization by you for that person to use the store on your behalf.
- You agree to use the store in good faith and with honesty and credibility.
- You agree to provide true, accurate, current, complete, and lawful information during registration and to update your information whenever it changes or when necessary.
- The store is committed to treating your personal information and contact details with strict confidentiality.
- If the store determines that you have provided false, inaccurate, outdated, incomplete, unlawful, or otherwise non-compliant information, it reserves the right to suspend, freeze, or terminate your membership or account without prejudice to any other rights or lawful remedies available to the store.
- Failure to comply with any of the above may result in suspension or termination of your account or restriction of your future access to the store’s services.
Article 6 – Electronic Communications and Official Communication Channels
- The parties agree that communications may be conducted through the email address registered on the platform.
- The customer agrees that all agreements, notices, statements, and other communications provided electronically shall have the same legal effect as written communications, where permitted by applicable law.
- The customer agrees that the store may communicate with them regarding this Agreement or their transactions through general notices sent to all customers or specific notices sent to individual users.
Article 7 – Amendments to the Usage Agreement and Fees
- If any provision of this Agreement is cancelled, invalidated, or becomes unenforceable, the remaining provisions shall continue in full force and effect.
- This Agreement, as amended from time to time where necessary, constitutes the governing framework and understanding between the customer and the store.
- The store may charge fees in connection with certain products, services, or promotional offers, as well as any fees or taxes imposed by applicable authorities.
- The store reserves the right to introduce, increase, reduce, waive, or otherwise modify fees or expenses in accordance with this Agreement.
Article 8 – Payment and Settlement Services
- The store provides payment services through its payment partners. Payments may be completed online using the payment methods available through the store or any other methods introduced from time to time.
- The store is responsible for setting the prices of the products or services offered through its platform in accordance with applicable market considerations.
- The store will provide invoices, receipts, and other relevant payment documentation for transactions conducted through the store and will provide customers with purchase invoices for products or services.
- The store will apply generally accepted accounting practices to its electronic operations in accordance with applicable legal, economic, commercial, and regulatory requirements.
Article 9 – Intellectual Property
- All intellectual property rights relating to the store are fully owned by the store, whether such rights existed before or after the establishment of the electronic platform.
- Customers must respect the store’s intellectual property rights, including its trade name, trademarks, wording, logos, symbols, and other proprietary materials displayed through the store.
Article 10 – Store Liability
- The store shall conduct its commercial activities through the electronic platform in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia and in accordance with this Agreement.
- The store shall not be liable for claims arising from errors or negligence that result directly, indirectly, or incidentally from the customer or from third parties such as shipping companies, to the extent permitted by applicable law.
- The store, its employees, owners, and representatives shall ensure that products and services offered are lawful, permitted, and compliant with the laws and regulations of the Kingdom of Saudi Arabia and are intended for lawful use.
Article 11 – Restriction of Access or Membership
The store may suspend or terminate a customer’s membership or restrict access to the platform’s services in accordance with this Agreement and applicable laws.
Article 12 – Governing Law
This Usage Agreement is governed by and interpreted in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia and is subject to the jurisdiction of the competent authorities in the Kingdom.
Article 13 – General Provisions
If any provision of this Usage Agreement is cancelled, invalidated, or becomes unenforceable, the validity and enforceability of the remaining provisions shall not be affected.
This Usage Agreement, as amended from time to time where necessary, constitutes the understanding and agreement between the store and the customer. The parties also agree to the following:
- Arabic shall be the governing language for the interpretation of this Agreement and in the event of any discrepancy arising from a translation into another language.
- Prices displayed for the store’s products or services may be amended from time to time.
- Promotional or marketing offers made by the store are temporary, and the store reserves the right to amend or discontinue such offers at any time.
- The parties agree to deal with one another in accordance with applicable Sharia principles and the laws and regulations governing the relationship between the store and the customer.
- This Usage Agreement may only be terminated in accordance with a decision of the store’s management and applicable laws.
